Terms and Conditions of Sale

The website hereinafter referred to as “the Website” and this document is the property of The Herbjar. 

The terms “we”, “us”, and “our” refer to The Herbjar. The terms “you”, “your” and “customer” refer to any individual, company or business to whom The Herbjar provides goods and/or services.

These Terms and Conditions apply to retail transactions between The Herbjar and you. For wholesale terms and conditions please contact The Herbjar directly by email or phone.

By using our Website, you expressly agree to these terms and conditions.

1. Product and Price Information

1.1. We reserve the right without prior notice to discontinue products or change product descriptions offered on this site without liability to you and without notice to you.

1.2. All prices are in £ GBP Pounds Sterling (UK Pounds) and are valid and effective only in the United Kingdom.

1.3. The prices listed on the Website apply to retail purchases only and are inclusive of all taxes and charges.

1.4. All prices are subject to variation without notice, and the prices currently listed on the website replace all previous lists.

2. Medical Liability

2.1. All Herbjar products are safety assessed in accordance with The Cosmetic Products (Safety) Regulations 2008. However, a small number of consumers are intolerant or allergic to substances, including those of natural origin, deemed perfectly safe for most consumers. Whilst we seek to provide as much information as possible about a product and its suitability, it is your responsibility to ensure the products you use do not contain ingredients to which you are intolerant, allergic or sensitive.

2.2. None of our products are to be used in place of medical treatment. The Herbjar does not give nor intend to give any answers to medical related questions. We do not represent ourselves as physicians nor is this implied.

3. Placing an Order

3.1. We must receive full, cleared payment for an order before we despatch the goods.

3.2. We will notify you by email as soon as possible to acknowledge receipt of your order and to provide you with an order number.

3.3. Unfortunately, we cannot guarantee that a product listed as "in stock" will actually ship right away, as inventory can change significantly from day to day. In rare cases, a product may be in stock when you place your order, and sold out by the time your order is processed. Should this happen, we will use our best efforts to notify you via email.

3.4. In the unlikely event of an item being out of stock we will send the remainder of your order and notify you via email about the out of stock item. You will have the choice between canceling the out of stock item or having it sent to you later in a separate package at no extra cost to you.

3.5. The Herbjar reserves the right to decline to trade or contract with any company, business, partnership or person whatsoever. If The Herbjar declines to accept an order where payment has been received, The Herbjar will refund the payment to you.

4. Your User Account and Personal Information

4.1. The Herbjar believes strongly in protecting user privacy. Please refer to our Privacy Policy Statement for information on how The Herbjar protects your privacy.

4.2. It is your responsibility to ensure that all details you provide to The Herbjar for the purpose of ordering are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods ordered.

4.3. If you supply incorrect or inaccurate address details and your order is returned to us as a result of this, a charge will be made for re-delivery, in accordance with Royal Mail charges.

4.4. You agree to defend, indemnify and hold harmless the Herbjar from any liability or expense arising from your providing inaccurate or false personal information and credit card details.

5. Payment

5.1. The Herbjar does not collect or store details on our system.

5.2. All on-line payments to The Herbjar are handled by PayPal. Paypall doesn not trasfer any customer debit or credit card details

6. Delivery

6.1. We will use reasonable endeavours to make delivery times as indicated within this website. However The Herbjar is in no way to be held responsible for deliveries taking longer then indicated.

6.2. Your parcel will only be considered missing if it fails to arrive 10 days after the approximate delivery date indicated in your order dispatch notification email.

 6.3. If the carrier has recorded a failed delivery and the goods are returned to us as you failed to pick up the goods within the time limits set by the carrier, we will treat this as a cancelled order and we will make a charge equivalent to Royal Mail’s recorded delivery charges.

7. Order Acceptance

7.1. You should inspect the merchandise upon receipt and check that everything specified on the delivery note is included.

7.2. You will be deemed to have accepted the order unless you notify us of any problem with your order within seven working days of receipt. If you fail to take such action, we are not obligated to accept any rejection by you of the merchandise at a later date. Your statutory rights are not affected.

8. Order Cancellation

8.1. You may cancel any order or part of an order within seven working days from the date you received it. To cancel, please email or write to us or just return the order to us. There is no obligation on your part to give a reason for your cancellation, however stating your reason for cancelling would help The Herbjar improve customer service.

8.2. If you cancel an order before it has been dispatched, we will refund the amount you paid in full.

8.3. If you cancel an order after it has been dispatched, the refund will be subject to a deduction of the original true cost of postage to us. The deductions do not apply where we have sent an incorrect item or if an order arrives damaged. Please see the” Faulty or damaged goods” section below.

8.4. Any refund of a dispatched order is subject to the order being sent back and received by us in its original package and in new, re-sellable condition. Please include the delivery note, invoice or order number in the package so that we can identify your order. We advise you to use recorded delivery and retain the proof of postage till such time as the refund has been completed.

8.5. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we may charge you for the reduction in value. This cancellation policy does not affect your legal rights - for example, if goods are faulty or misdescribed.

9. Faulty or Damaged Goods

9.1. The following qualify as faulty or damaged goods:
a) goods which were not what you ordered or are of a different quantity to that stated on your order form and
 b) goods damaged in transit.

9.2. The Herbjar will make good any shortage or non-delivery, replace or repair any damaged or defective goods, or, at your discretion, refund to you the amount you paid for the goods in question provided that you notify us of the problem within seven working days from the receipt of the goods and return the defective goods to us. We will refund your postage up to the value of the cheapest method of recorded delivery available.

10. Website Terms of Use

10.1. The site is provided by The Herbjar  on an "as is” and “as available” basis. The Herbjar  make no representation or warranties of any kind, express or implied, as to the operation of the site or its content. The Herbjar  will not be liable, under any circumstances, for any interruption of business, access delays or access interruptions to this site, or data non-delivery, misdelivery, corruption, destruction or other modification.

10.2.The Herbjar  shall not be liable to any person for any loss or damage, which may arise from the use of any of the information on this Web site.

11. Copyright and Trademarks

11.1. All the content on the Website, including, but not limited to, text, photos, graphics, logos, and the compilation thereof (collectively, the "Content") is the property of The Herbjar, and is protected by United Kingdom and international copyright laws. The Content of the Website may not be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in whole or in part, for any purpose without our prior written consent.

12. Amendments to the Terms and Conditions

12.1. The Herbjar reserves the right to amend these Terms and Conditions of Sale at any time. The amended terms shall be effective immediately after they are posted on the Website.

12.2. Your continued use of our Web site following the posting of such amended terms shall constitute your acceptance of any such changes. Your continued use of our web site following the posting of changes to these terms means that you consent to those changes.

This version of the Terms and Conditions is effective as of the 1st of January 2010.
